Terms of Service
General terms
Agreement. By using the Retro Rematch website and services, including submitting photos, requesting or accepting an estimate, or shipping a collection to us, you agree to these Terms of Service.
Eligibility. You must be at least 18 years old, or the age of majority where you live, to submit a collection or accept an estimate. By submitting photos, accepting an estimate, or shipping a collection to Retro Rematch, you confirm that you meet this requirement.
Estimate. The estimate is a preliminary figure based on the information and photos you provide. Once you accept your estimate and ship your collection, you have agreed to sell it to Retro Rematch and all sales are final, unless the final value of a game is adjusted upon inspection. Your estimate is locked for 14 days after we send it. After that, a new estimate with current market prices must be submitted.
Inspection results. After we receive and inspect your collection, we send you your inspection results. The value of a game may be adjusted from the estimate based on authenticity, completeness, functionality, and condition. If we lower the value of a game, you may choose to accept the new value or have that game returned to you instead of sold, and the cost of return shipping is deducted from your payout. A game valued at $0 is not considered adjusted and is not returned, including counterfeit games and games that do not work.
Right to adjust. We may adjust the condition we assign to any game, and the value we give it, based on our Condition Guidelines and for any other reason we see fit in determining the game’s final value. If we lower the value of a game, you may accept the new value or have the game returned to you, as described under Inspection results above.
Right of refusal. We reserve the right to refuse any product for any reason.
Shipping. Where a prepaid label is provided, you are responsible for packing your items securely. Coverage for packages that are lost or damaged on the way to us, including optional insurance, is explained in Optional shipping insurance below.
Payment. Payment is made after you accept your inspection results and we approve the payout. Once a payment is sent, it is final. You are responsible for the payout details you give us, and we are not responsible for any issue arising from incorrect information provided for payment details, including a payment sent to the wrong account.
Accuracy of information. You confirm that the photos, descriptions, and notes you give us are accurate and complete, including the condition of each game and any missing parts. We rely on them to prepare your estimate, and we may adjust the value of a game, or refuse it, if they are not accurate.
Changes to these terms. We may update these Terms at any time by posting the updated version on this page. By continuing to use the services after an update, you accept the updated Terms.
Severability. If any part of these Terms is found to be unenforceable, the rest of these Terms remains in effect.
Governing law. These Terms, and any dispute arising out of or relating to them or to the services, are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any such dispute must be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.
Ownership
By submitting a collection, you confirm that:
- You own the games you send, and you are selling them on your own behalf and not on behalf of anyone else.
- The games you send are not stolen. You did not obtain them through theft, burglary, robbery, fraud, deception, or any other unlawful means, and you have no reason to believe that anyone before you obtained them that way.
- The games you send are not counterfeits, reproductions, or bootlegs, and are not otherwise fraudulent. Each is a genuine product as it was originally manufactured and sold.
- The games you send do not infringe anyone else's intellectual property rights, including copyrights, trademarks, and patents, and selling them to us does not infringe those rights.
Optional shipping insurance
Coverage
- Every prepaid label includes up to $100 of USPS coverage at no cost to you. You may add optional insurance of $100 to $5,000, provided by a third-party insurer (currently ParcelGuard), not by Retro Rematch.
- Coverage applies only to a package shipped on the prepaid label we provided for it. Insurance must be chosen on the shipping details step, before your label is created, and cannot be added afterward. If you ship on your own, none of this section applies.
- You are responsible for your package until it arrives at our facility. Except as described in this section, Retro Rematch is not liable for items lost, stolen, or damaged in transit.
Cost
- The premium depends on the coverage amount you choose and is shown before you request your label. You do not pay it upfront. It is deducted from your payout when you accept your inspection results, or from a claim payment if one is paid instead. The premium is deducted only once.
- Coverage above your estimated payout does not increase what you can receive and only increases the premium.
If your package is lost or damaged
- Contact support@retrorematch.games as soon as you think there is a problem, with your reference and tracking numbers. Insurers and carriers set filing deadlines, so please do not wait.
- We file the claim for you, one claim per shipment: against your optional insurance if you bought it, and otherwise against the included USPS coverage. The two are not combined.
- We may ask for your packing list, photos of how you packed, or proof of value. A claim may be delayed or denied without them.
- Insurers and carriers set when a claim can be filed (for a lost package, generally about 20 days after the ship date), so a claim can take several weeks or longer. You will not be paid until the claim is resolved and the proceeds have been paid to us.
What we pay
If a claim is approved and paid, we pay you the proceeds we actually receive, up to the lesser of your coverage amount ($100 if only the included USPS coverage applies) and the estimated value of your payout (your accepted estimate), less any premium not already deducted.
Our obligation is limited to filing the claim in good faith and paying you what we receive. We do not guarantee that a claim will be approved or how much will be paid.
Exclusions apply
A claim may be denied, among other reasons, when:
- the shipment was never scanned by the carrier (for example, it was not handed to the carrier, or there is no record that it was accepted);
- damage results from improper packaging, such as a box that is too large or too small, too little padding, or a box that is not securely sealed;
- the package was lost or stolen while shipped in original manufacturer packaging or any packaging that shows what is inside (the insurer excludes loss and theft in these cases, so use a plain shipping box);
- the shipment is clearly fraudulent or made in bad faith; or
- another exclusion in the insurer’s or carrier’s terms applies.
Packing and shipping
Please follow the packing guidance on our Shipping Information page: use a plain, sturdy shipping box, pad it so nothing shifts, seal every seam, and hand the package to the carrier so that it is scanned. Keep your drop-off receipt and tracking number until your sale is complete.
Indemnification
You agree to indemnify, defend, and hold harmless Retro Rematch and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, that arise out of or relate to:
- your breach of these Terms, including any statement under Ownership that is untrue;
- the games you send, including any claim that a game is stolen, is counterfeit, or infringes anyone else's rights; or
- your use of the website and services.
Limitation of liability
To the fullest extent permitted by law, the website and services are provided “as is” and “as available,” and Retro Rematch is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the website or services. Except for the purchase price we agree to pay you for games we buy, and the insurance claim payments described in Optional shipping insurance above, our total liability to you for any claim is limited to the purchase price of the games at issue.
